I. General Terms and Conditions

§ 1 General Provisions

(1) The following terms and conditions apply to contracts that you conclude with us as the supplier (Patricia Schitter) via means of distance communication (e.g. telephone, email). Unless otherwise agreed, the inclusion of any terms and conditions of your own that you may use is hereby rejected.

(2) A consumer within the meaning of the following provisions is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity. An entrepreneur is any natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the course of their self-employed professional or commercial activity.

§ 2 Conclusion of the Contract

(1) The subject matter of the contract is the provision of chargeable services in the form of jewellery consultations.

(2) Our offers on the internet are non-binding and do not constitute a binding offer to conclude a contract.

(3) You may submit enquiries to us via means of distance communication (e.g. by telephone or email). Your enquiries are non-binding. We will provide you with a binding offer in writing (e.g. by email), which you may accept within 5 days (unless a different acceptance period is specified in the relevant offer).

§ 3 Provision of Services

(1) Insofar as individual jewellery consultation and/or the creation of a personalised presentation of results form the subject matter of the contract, we are obliged to provide the individual services set out in the service description in the relevant offer. We shall provide these to the best of our knowledge and belief.

(2) Services shall be provided on the agreed dates and in the agreed manner (e.g. via Zoom or Google Meet, by telephone or email)

(3) You are obliged to cooperate insofar as further information must be provided to us in order to perform the services.

(4) Where special conditions apply to the use of our services, these shall be set out in the relevant quotation.

(5) If a consultation appointment is cancelled due to the service provider being unable to attend at short notice because of illness or for any other valid reason, the cancelled appointment will be rescheduled for an alternative date.

§ 4 Cancellation of services

(1) You may cancel your booking of services free of charge up to 48 hours before the agreed appointment.

(2) Cancellation must be made in writing (e.g. by email). The date on which we receive your notice of cancellation shall be decisive for determining whether the deadline has been met.

(3) Cancellation less than 48 hours before the agreed appointment will incur a charge.
A cancellation fee of 50% of the agreed fee will be charged for this. You reserve the right to prove that we have in fact incurred no costs or significantly lower costs.

(4) In the event of non-attendance or partial attendance at the booked consultancy service, no refund is possible.

(5) The statutory right of withdrawal remains unaffected by this; it exists regardless of the existence or non-existence of this additional right to cancel.

§ 5 Use of Zoom

(1) Where specified in the relevant offer, we use the video tool “Zoom” provided by Zoom Video Communications, Inc. (55 Almaden Boulevard, San Jose, CA 95113, USA) to provide the service. Further details on the use of Zoom can be found in our privacy policy as well as in Zoom’s terms of service and privacy policy, which you can access and view online via the following links:

(2) To use Zoom, you must register as a participant with Zoom. To this end, we will provide your email address and name to Zoom in advance (for verification purposes) and send you the link for your Zoom participation by email (in the case of paid services, unless otherwise agreed, only after receipt of payment). The individual technical steps for registration are then guided by the Zoom menu once you have clicked on the link sent to you. You will also find instructions on how to proceed in the email.

§ 6 Use of Google Meet

Where indicated in the relevant offer, the service is provided using the video communication service “Google Meet” operated by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). Further information on Google’s terms of use and privacy policy can be found at www.google.com/privacypolicy.html.
We will send you the participation link by email (in the case of paid services, unless otherwise agreed, only after receipt of payment).

§ 7 Copyright

The materials, documents and files created by us are protected by copyright. You may not reproduce these works – or parts thereof – in any form, whether for private or professional purposes, without our express consent; in particular, you may not process, duplicate, distribute or use them for public display using electronic systems.

§ 8 Right of retention

You may only exercise a right of retention insofar as the claims arise from the same contractual relationship.

§ 9 Choice of law

(1) German law shall apply. In the case of consumers, this choice of law shall apply only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence (principle of favourability).

(2) The provisions of the UN Convention on Contracts for the International Sale of Goods shall expressly not apply.

The contract is concluded in accordance with the provision “Formation of the Contract” in our General Terms and Conditions (Part I).

3. Contract Language, Contract Text

3.1. The contract language is German.

3.2. In the case of enquiries regarding offers made via means of distance communication, you will receive all contractual details as part of a binding offer in writing, e.g. by email, which you may print out or save electronically.

4. Essential features of the service

The essential features of the service are set out in the relevant offer.

5. Prices and payment terms

5.1. The prices stated in the respective quotations are total prices. They include all price components, including all applicable taxes.

5.2. The following payment methods are available to you, unless otherwise agreed:

- Payment by invoice

The invoice amount is payable within 7 days.

5.3. Payment claims arising from the concluded contract are due for payment immediately, unless otherwise stated in the relevant quotation or agreed individually.

6. Statutory liability for defects

The statutory rights regarding liability for defects apply.
